Rebuttal to Claims of Anti-Competitive Behavior

The Dry Eye Foundation is a 501(c)(3) non-profit education and advocacy organization for individuals suffering from ocular surface disease and keratoneuralgia. The Board of Directors is composed of Rebecca Petris (president), Amanda Mott (vice president) and Cynthia Edwards, RN, MSN (member at large), who suffer from chronic ocular surface diseases, as well as Aidan Moore (treasurer and secretary), and ophthalmologist Sandra Brown MD (member at large) who is the medical consultant for the Foundation. The Board of Directors determines and implements the Dry Eye Foundation’s Conflict of Interest Policy.

Rebecca Petris has owned and operated the Dry Eye Shop since 2005. The need for the Dry Eye Shop became evident to her through her own struggles with chronic ocular surface disease.

The Dry Eye Shop (which is not affiliated with the Dry Eye Foundation) has never offered for sale a biologic eye drop containing ingredients derived from human reproductive tissues or liquids. It does not offer for sale any eye drop product that contains unspecified "trademarked" or "patented" ingredients. It does not offer for sale any eye drop product that is manufactured exclusively for the Dry Eye Shop. All of the eye drop products currently available through the Dry Eye Shop are available over-the-counter in drugstores, or through other on-line retailers.

Regener-Eyes LLC's claims that biologiceyedrops.org is an anti-competitive effort on behalf of the Dry Eye Shop are demonstrably false and ridiculous. These claims are designed to distract eye care providers and patients from the reality that Regener-Eyes eye drops are unapproved and not in compliance with multiple FDA regulations, including regulations related to correct packaging of non-preserved eye drops.

Sincerely,

BOARD OF DIRECTORS, DRY EYE FOUNDATION
